Terms of Service

Please read these terms carefully before using the EmailVerifyerAPI email verification platform. By using the service you agree to be bound by them.

In plain language

Use EmailVerifyerAPI to check email addresses you're allowed to check, and don't try to break, resell or overload the service. We give you the tool "as is" and can't promise an address is 100% deliverable, since verification reduces bounces but doesn't guarantee delivery. Either of us can end your account; if we make big changes to these terms we'll tell you.

1. Introduction

These Terms of Service ("Terms") form a binding agreement between you (or the organisation you represent) and EmailVerifyerAPI ("EmailVerifyerAPI", "we", "us") governing your use of the EmailVerifyerAPI website, email-verification tool and related services (the "Service"). They take effect when you first use the Service or create an account, whichever is earlier. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.

These Terms are a good-faith starting point and should be reviewed by qualified legal counsel for your jurisdiction before launch.

2. Definitions

  • Service: the EmailVerifyerAPI website, email-verification tool, dashboard and any API we make available.
  • Account: the registered profile through which you access paid or authenticated features.
  • User / Customer: the individual or organisation using the Service.
  • Verification Result: the output we return for an address you check (e.g. valid, risky, invalid, and the underlying signals).
  • API: the programmatic interface to the Service, where offered.

3. Account Registration

The free browser tool does not require an account. For features that do, you agree to provide accurate information, keep your credentials secure, and notify us promptly at [email protected] if you suspect unauthorised access. You are responsible for activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create one.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Verify email addresses for the purpose of sending unsolicited commercial messages (spam).
  • Harvest, scrape, or compile email addresses from third-party websites without permission.
  • Circumvent technical limitations, rate limits, or access controls.
  • Resell or sublicense access to the Service without written authorisation.
  • Upload lists that contain personal data you are not authorised to process.
  • Probe, scan, or test the vulnerability of any EmailVerifyerAPI system or network.

Violation of this policy may result in suspension or termination of your access, and, where warranted, referral to the appropriate authorities. We may also remove or refuse to process content that breaches these Terms.

5. Service Availability

The Service is currently offered free of charge and is provided on an "as available" basis. We do not offer a contractual uptime guarantee or service-level agreement at this time. We aim for high availability and may carry out maintenance, occasionally with little notice. If and when we introduce paid plans with a formal SLA, the applicable terms will be published and linked here.

6. Fees & Billing

Single-address verification and bulk CSV upload (up to 10 addresses at a time) are currently free, with no account or payment required. Paid plans and a hosted API are planned but not yet released or priced. When paid features launch, we will publish pricing and payment terms (including billing cycle, taxes, failed-payment handling and any refund policy) before you are charged, and your use of those features will be subject to them.

7. Data Processing

To the extent that your use of the Service involves the processing of personal data (as defined under applicable privacy law), the terms of our Privacy Policy and, where applicable, our Data Processing Agreement (DPA) apply. A copy of the DPA can be requested at [email protected].

Where you use the Service to process personal data, you act as the data controller and EmailVerifyerAPI acts as the data processor on your documented instructions, consistent with Article 28 of the GDPR where it applies.

8. Intellectual Property

EmailVerifyerAPI and its licensors retain all rights, title and interest in the Service, including its software, technology, brand and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. As between you and us, you own the Verification Results generated from addresses you submit, and you are responsible for how you use them.

9. Confidentiality

Each party may receive information that is confidential to the other, such as non-public pricing, API keys, or account data. Each party agrees to protect the other's confidential information and to use it only as needed to perform under these Terms. This does not apply to information that is or becomes public through no fault of the receiving party, was already known to it, is independently developed, or must be disclosed by law.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Verification Results are informational and probabilistic: they reduce the likelihood of bounces but do not guarantee that any address is deliverable or that a message will be delivered.

11. Limitation of Liability

To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or CAD $100. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold EmailVerifyerAPI harmless from third-party claims, damages and reasonable expenses arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party right, including processing personal data you were not authorised to process.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The parties will first attempt to resolve any dispute informally by contacting each other; if that fails, the dispute will be subject to the exclusive jurisdiction of the courts located in Montréal, Québec, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.

Before launch: confirm the governing-law jurisdiction and dispute-resolution mechanism with legal counsel.

14. Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes by email to the registered account address. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree to the revised Terms, you may terminate your account before the effective date.
